NY State Bar Association Proposes Franchise Law Revisions

The Business Law Section of the NY State Bar Association approved on December 11, 2009, a report and proposed changes in the New York franchise laws proposed by the Section's Franchise, Distribution and Licensing Committee. The proposed changes would modernize the New York Franchise Act, largely conforming its requirements to those of the Federal Trade Commission's trade regulation rule on franchising and the franchise laws of other states. Tom Pitegoff is the chair of the legislation subcommittee that wrote the report and the proposed changes in the law and regulations.

Pitegoff Named to the 2010 New York Super Lawyers List


Tom Pitegoff was selected for inclusion in Super Lawyers 2010 as one of the top attorneys in the New York metro area in the field of franchising. The publisher, Law & Politics, identified qualified candidates using a multi-step evaluation process of nominations, peer evaluation and internal research. The Super Lawyers list includes only five percent of the lawyers in New York. Mr. Pitegoff is the only franchise lawyer in Westchester County on the Super Lawyers list.

Pitegoff Advises Sumitomo Corporation of America in Acquisition
of TBC Corp.

Tom Pitegoff was a member of the legal team that represented Sumitomo Corporation of America ("SCOA") in its acquisition of the tire retailer TBC Corporation. The the transaction closed November 17, 2005, making TBC a subsidiary of SCOA. The total value of the transaction is approximately $1.1 billion including debt. TBC markets automotive replacement tires at retail locations under the names Tire Kingdom, Merchant's Tire & Auto Centers and National Tire & Battery. In addition, it franchises retail tire stores under the name Big O Tires. SCOA, which already owned tire wholesaler Treadway, is the U.S. unit of Japanese general trading company Sumitomo Corp. Mr. Pitegoff acted as SCOA's franchise counsel.
